The News

Three men — David van der Linden, Armand Schultz, and Johannes Kamati — made a first pretrial appearance in the Windhoek High Court on charges of dealing in cannabis, possession of cannabis, and money laundering in connection with the discovery of a cannabis plantation at farm Eendrag in the Okahandja district. The case involves about 2.38 tonnes of cannabis valued at approximately N$55.1 million and was postponed to 17 February for a second pretrial hearing.

    The High Court dismissed former ministry of health and social services senior accountant Ricardo Hitikua's appeal against his dismissal for being absent from work for more than 30 consecutive days. Acting judge David Mangota ruled that weekends and public holidays count towards the statutory period of absence under the Public Service Act, finding that the law refers to consecutive calendar days rather than working days.

  3. High Court rejects RedForce's urgent bid against minister's directive

    The High Court ruled that urban and rural development minister James Sankwasa did not expressly direct the municipality of Walvis Bay to immediately terminate its RedForce Debt Management contract, striking the company's urgent application and leaving its substantive challenge unresolved. The judge found RedForce had failed to establish urgency and ordered the company to pay the minister's legal costs.

    Two men accused of robbing and murdering Walvis Bay resident Vernon Gavin in his home on 30 December 2023 have been found not guilty on two rape charges. Judge Philanda Christiaan discharged Quanito van Vuuren (28) and Sem Moses (23) in the Windhoek High Court; they remain accused of the robbery and murder.

  2. Fishrot accused seek High Court order for state charge details

    Ricardo Gustavo and Namgomar Pesca Namibia have requested the High Court order the state to provide more details on charges including racketeering, money laundering, conspiracy to commit corruption, corruptly giving gratification, fraud and tax evasion. Judge Eileen Rakow postponed the hearing on the application for further particulars to 11 November.

    The City of Windhoek says residents affected by the N$381-million Eneas Peter Nanyemba Road upgrade must relocate to Extensions 8 and 11, even though servicing of Extension 11 only begins in September 2027.     A High Court judge has temporarily suspended the Walvis Bay Town Council's decision to terminate its five-year debt collection contract with RedForce Debt Management.     The High Court has temporarily blocked the municipality of Walvis Bay from terminating its debt-collection contract with RedForce Debt Management CC, preventing the municipality from withdrawing RedForce's mandate or cutting off its access to municipal debtor information.   1. DBN wins N$26m default judgment against Nghipondoka and sister

    The Development Bank of Namibia has secured a Supreme Court appeal judgment against businessman Vaino Nghipondoka and his sister Turki for N$26.48 million. The court found that a July 2023 settlement between DBN and two of Nghipondoka's companies did not release him and his sister from liability for a N$15.9 million property finance loan obtained by Growmax Agri-Fertilizer in May 2017, for which they had entered into written suretyship agreements.

  1. Murder accused claims unknown attacker killed teen girlfriend

    Isak Blockstaan, 31, told a Windhoek High Court judge this week that he and his then girlfriend Hannalie Swartbooi, 15, were attacked by an unknown person or persons while walking home from a birthday party in the Gibeon area on the night of 2 to 3 May 2021, during which Swartbooi was fatally assaulted.

  1. Medical intern admits giving sedative during alleged rape

    Intern medical doctor Dennis Noa told Ondangwa Magistrate's Court during a bail application that he gave diazepam to a 26-year-old man he is accused of raping on 18 July, but claims the sexual encounter was consensual. Noa testified that the complainant had requested to visit his home to celebrate a new job, and that he provided the medication after they had eaten, drunk beer and vodka, and had sex.

    A 25-year-old gym instructor admitted guilt in the Windhoek High Court to nine charges including the murder of bank employee Frieda Amadhila (29), his former girlfriend, after breaking into her flat in April 2024.     A pathologist testified in Windhoek High Court that the body of Lydia Kharises (23), found killed in Dordabis in late 2021, had been carefully mutilated with a sharp object after death, including removal of pubic skin and her uterus.     The Construction Industries Federation supports a High Court decision that reversed industries minister Modestus Amutse's approval of a merger between Namibia's two cement companies, arguing that cement is too important to the construction and infrastructure sectors to be treated as a purely commercial transaction. The court found that Amutse had not considered objections against the proposed acquisition of Ohorongo Cement by Whale Rock Cement.

    Jonas Murao, a Hardap region farmworker convicted on six charges including the rape of a four-month-old baby, is scheduled for sentencing in the Windhoek High Court on 30 October. Judge Claudia Claasen found him guilty of housebreaking, rape, attempted rape, and indecent assault following events at Hoachanas between 2008 and 2016.

  2. Windhoek High Court voids lithium company's mining licence

    The Windhoek High Court has set aside the mining licence granted to Chinese-owned Xinfeng Investment in September 2022, finding that the company's licence application contained misleading information that materially affected the former mines minister's decision.     A Windhoek High Court judge found two ||Kharas region residents guilty of multiple sexual crimes against a girl between October 2020 and January 2021, when she was 11 years old. One man was convicted of one count of rape, two counts of committing indecent or immoral acts with a minor, and three counts of trafficking in a person; the other was convicted of two rape counts and one trafficking charge.

    The High Court has ordered the attachment of 200 million Trustco Group Holdings shares and 1,135 unlisted Legal Shield Holdings shares linked to US-based Riskowitz Value Fund LP, temporarily preventing the investor from selling or transferring the shares. The interim order was granted on 25 September as the two parties dispute control of the Namibian investment group, with the dispute linked to a N$468 million transaction and RVF's attempts to influence Trustco's board.

  1. Man convicted of stabbing girlfriend to death in Keetmanshoop

    Johannes Saul Claasen was found guilty by High Court Judge Dinah Usiku of murdering his girlfriend Ridensia Lamberth on 25 December 2020 in Keetmanshoop by stabbing her in the chest. He also faced charges of attempting to murder their 11-month-old daughter and assault with intent to cause grievous bodily harm.

    A 36-year-old Kavango East resident has indicated his intention to plead guilty to murder and attempted murder charges in the Windhoek High Court. He is accused of killing his mother in November 2024 and attempting to kill his father during the same incident.

  2. Retired Chief Justice Strydom honoured at Supreme Court

    Retired chief justice Johan Strydom, who died at age 88, provided indispensible leadership that helped shape Namibia's judiciary after independence in 1990, Chief Justice Peter Shivute said at a valedictory court session. Strydom, the first judge president of the High Court after independence and the country's third chief justice, helped transform the legal system from one built to repress into one built to protect.
